Fences (Il Contadino July 1998 - by Avv. Mario Casari)
Fencing a fund, even with a wall, involves compliance with standards other than those envisaged for building walls (whether or not they are part of a real building). The law does not establish the quality of the materials or the thickness of the enclosure wall, it can also be a drywall that has stability and foundations, but must not however exceed the height of 3 meters. It can be placed a short distance from the border if the purpose it is intended to build or defend spaces and buildings inside, but it can also be located on the border (in this case the neighbor has the right to make it common). It is not, as we said, a construction wall for which the distances from the border or the neighboring construction are not worth it. However, it must respect the distance of three meters if on the nearby bottom there is a building with a direct view (window or balcony), And this is to prevent the view from being disturbed or obstructed. The factory walls that must respect certain distances are quite different, either from the border or from neighboring buildings in accordance with the forecasts and rules established by municipal regulations (generally 5 meters from the border and 10 meters from the houses). There are also so-called retaining walls for uneven floors which serve to prevent landslides to the upper bottom and which belong to the latter with all maintenance and custody charges. Being considered construction walls, the particular distances from the borders as well as any factory wall are valid. The bottom can then be fenced in any way with low walls, with fences, with hedges, with wooden or iron posts to which iron wires are fixed; the fence must be made on the bottom you intend to fence and take place so that the outer band of the fence does not cross the border (the hedges must respect the distances of mt. O.50). Among the ways of fencing, the construction of a ditch or a canal can also be noted, but in this case the ditch must be located at a distance from the border equal to the depth of the same. Of course, any work that entails changes in the conditions of the structure of the land must be authorized by the administrative authority, therefore before building or fencing it is necessary to submit a relative application for this purpose. The same administrative authority (usually the municipality) can provide for rules or methods other than those mentioned, so before undertaking any type of work it is good to inquire.
